It’s no secret that cannabis legality can be complex and confusing. You have to juggle federal law with state regulation, and it’s easy to end up feeling some level of uncertainty about what’s legal and what isn’t.

So, are pre-rolls legal? This is a pretty loaded question with a few moving pieces. What’s in the pre-roll, exactly? What state are you in? These are the two things you need to consider to find out if you can enjoy legal pre rolls or not.

The short answer, though, is yes. You can legally buy a THCa pre roll here at Flowerz thanks to the passing of the 2018 Farm Bill. This bill made all hemp-based products federally legal, provided they contain less than 0.3% THC by dry weight.

Since our pre-rolls check those boxes, you can experience an authentic cannabis experience shipped straight to your door. Treat yourself today, or learn more about pre-roll legality below.

What is a Pre-Roll?

You’re probably well aware of what joints are. These are the classic way to enjoy cannabis, especially in social settings. They can be passed around for all to enjoy.

A pre-roll is simply the most convenient way to enjoy joints. You don’t have to grind the flower and roll up yourself. You’re buying a pre-rolled joint. Just spark and enjoy right out of the package! No mess, no inconsistencies, no hassle.

Don’t get us wrong – we still love rolling joints by hand every now and then. But the vast majority of people will find machine-rolled joints burn much more evenly with a smooth draw every time.

They’re more precise in how much flower is in the joint, too, so there’s no guessing game about how much you’re consuming. On that note, you can find pre-rolls in an abundance of sizes, ranging from 0.5g mini pre rolls to 1.5g king size pre rolls, and everything in between.

Whether you’re looking for a mellow evening unwind or an energizing midday boost, there’s a pre-roll to match your vibe. But, are pre-rolls legal?

Are Pre-Rolls Legal?

Being able to buy pre-rolled joints packed with THCa flower sounds too good to be true. So, are pre-rolls legal? It’s not as easy an answer as yes or no. Cannabis laws vary by federal, state, and local jurisdictions. What’s legal in one place might be more heavily regulated in another.

It ultimately comes down to where you’re trying to ship the pre-roll to and what’s inside it – more specifically, if it contains hemp-based flower or marijuana. Let’s start by explaining the revolutionary 2018 Farm Bill.

The 2018 Farm Bill

The 2018 Farm Bill redefined cannabis law in the U.S. by setting a clear distinction between hemp and marijuana. Hemp is legally defined as cannabis containing less than 0.3% Delta-9 THC by dry weight. It’s 100% federally legal today.

On the other hand, marijuana contains much higher delta 9 THC percentages – this is the psychoactive cannabinoid you think of when associating a “high” with cannabis use. It remains federally illegal even though most states have legalized either medicinal or recreational use.

What’s in the Pre-Roll?

All that being said, you can find legal pre rolls by knowing what to look for. Traditional marijuana pre rolls are not federally legal, though you might be able to purchase these legally in your state depending on local regulations.

In contrast, hemp-derived pre-rolls contain THCa flower. This is the precursor to delta 9 THC and contains no psychoactive properties – at least, on its own. The moment you spark the pre-roll, though, a process known as decarboxylation occurs.

This converts the THCa into delta 9 THC, in other words, providing you with the authentic cannabis experience. Yet, THCa pre rolls are legal federally, thanks to a legal loophole in the 2018 Farm Bill.

So, Are Pre-Rolls Legal in the US Under Federal Law?

Yes, as long as they meet the legal definition of hemp under the 2018 Farm Bill. We might be starting to sound like a broken record, but that means the pre-roll needs to contain less than 0.3% Delta-9 THC. They can contain highly potent THCa flower, though!

Where things get tricky, though, is that federal legality doesn’t always translate to state legality. So, are pre-rolls legal in your state?

Are Pre-Rolls Legal in Your Specific State?

The good news is you can legally buy hemp-derived pre-rolls in most states in the US – online for the ultimate convenience. That said, some states have banned or restricted THCa flower and similar products. These include:

  • Idaho: All hemp products containing any THC, including THCa, are prohibited.
  • Indiana: Smokable hemp products like THCa pre-rolls are banned.
  • Kentucky: Selling hemp flower directly to consumers is prohibited. Only licensed processors and distributors can handle these products.
  • Louisiana: All smokable hemp products, including THCa flower, are banned. That means pre-rolls are a no-go.
  • New York: State law takes the potential conversion of THCa to THC into account and has made THCa flower illegal.
  • North Dakota: The state defines total THC as the sum of THC and THCa, so THCa flower is illegal.
  • Rhode Island: State law considers the conversion of THCa into THC in hemp flower post-harvest, making THCa flower illegal.
  • Utah: The production, sale, or use of smokable hemp flower is illegal.
  • Vermont: The conversion of THCa into THC is taken into consideration here as well, so THCa flower is illegal.
  • Wisconsin: State law calculates the potential conversion of THCa into THC, making THCa flower illegal.

But everywhere else can legally enjoy pre-rolls! The tricky thing about cannabis legislation, though, is it’s constantly evolving. What’s legal today might be illegal a year from now, and vice versa.

That’s why we encourage you to do your due diligence based on your specific state to find out whether you can enjoy legal pre rolls or not. If you can, look no further than Flowerz.

Tips on Enjoying Pre Rolls Legally

Just because pre-rolls are legal doesn’t mean you can do whatever you want with them. You still need to understand laws regarding where and how you can smoke them, traveling with them, and of course, driving after smoking one.

But let’s start with picking the perfect pre-rolls for your specific goals so you can get the effects you’re craving – be it something uplifting, relaxing, or in-between.

Which Pre-Rolls Are Right For You?

Choosing the right pre-roll depends on your preferences, lifestyle, and intended experience. This is what’s so great about pre-rolls at Flowerz – there’s literally something for everyone!

Start by considering the strain type. Our sativa pre rolls are great for daytime use, whether you want a creative, energetic burst at work or you’re exploring nature. They are more uplifting.

Our indica pre rolls, on the other hand, are your go-to for unwinding in the evening. They’re known for producing a deep sense of relaxation and leaving your body feeling weightless. For the best of both worlds, stick with our hybrid pre rolls.

Then, pick between our standard, mini, and king size pre rolls. Think about whether you’re enjoying alone or with company, and how high you want to get from each pre-roll. Our minis are perfect for solo sessions, while our king size pre rolls are great for sharing.

Some pre-rolls contain added extracts for enhanced potency, but we don’t do this. We think the quality of our flower speaks for itself and we’re confident you’ll agree!

Where You Can and Can’t Smoke Pre-Rolls

Public consumption is typically not a good idea, even in states where THCa pre-rolls are legal. Can you typically get away with smoking a joint in a public park? Yes. Is it worth the risk? We think not.

We also don’t love what this does to solidify stoner stereotypes when you’re exposing others to the smell and smoke, especially with kids around. We recommend smoking only on private property. Avoid smoking in:

  • Parks
  • Beaches
  • Parking lots
  • Vehicles
  • Airports
  • Public buildings/stores

When in doubt, err on the side of caution and assume you can’t smoke where you are if it’s not your home or someone you know’s home.

What You Need to Know About Traveling With THCa Pre-Rolls

Traveling with THCa pre-rolls opens up another can of worms, especially when it comes to flying. Even though THCa pre-rolls are federally legal, there can be issues when you bring them across state lines.

TSA does not actively search for cannabis products, but if they stumble across your pack of pre-rolls prepare for questioning and potentially having them confiscated – if not dealing with more serious legal consequences. We do not recommend flying with THCa pre rolls.

The same can be said for driving across state lines, even if THCa pre rolls are technically legal in both states. Of course, you should never drive after smoking a pre-roll. This is no different than driving under the influence of any other substance, like alcohol.

If you’re going to travel with THCa pre rolls keep them sealed in their original packaging so you can show they’re hemp-derived and compliant with federal/local laws. Keep them in the trunk, out of reach. Follow these tips and you should have nothing to worry about!

How is Rosin made?

Rosin can be made from either cannabis flower or hash, which is the collected kief (trichomes) of the Cannabis plant. If you have a grinder with a kief catch, you are probably already familiar! Rosin made from cannabis nugs tends to be slightly more difficult to enjoy, as plant matter almost always impacts the rosin. This does not impede the rosin’s potency but can cause an unpleasant flavor or smell for the user.

Once the cannabis source material is chosen, heat and pressure are applied. Most rosin for sale in dispensaries is created in a custom industrial press, though some users choose to make their own rosin at home with a hair straightener.

The applied heat and pressure to the cannabis material force out the cannabinoids and terpenes, similar to how canola or olives are pressed for oil. The end result is a cannabis concentrate with THC, CBD, and other cannabinoids as well as terpenes. The temperature and pressure applied correlate to the type of rosin produced. Rosin can be made into shatter, budder, taffy, and wax consistencies.
